Southeast Iowa Auto Accident Attorney

Whether you’ve been involved in an auto accident as a driver, passenger, motorcyclist, bicyclist, or pedestrian, you may be entitled to a large settlement or personal injury verdict under Iowa law. At the Noyes Law Office in Fairfield, lead attorney Ed Noyes and his staff have been representing individuals across southeast Iowa for two decades in recovering damages for their auto accident claims. See what Ed and his team of Southeast Iowa auto accident attorneys can do for you in helping you recover from your accident so that you can get back on the road to financial freedom.

Can I File an Auto Accident Suit Even if I Have Insurance?

Yes. Iowa has what is called a “fault system.” Unlike states that impose a no-fault system, Iowa allows an injured plaintiff to recover from the driver who was at fault in causing the accident, even if the plaintiff has his or her own insurance. If the defendant is found to be at fault, he or she will be responsible for paying your full range of damages, including those above insurance coverage limits.

Who Can I Sue in my Auto Accident Claim?

You can sue the operator of the vehicle who was at fault in causing the accident, as well as the employer of the operator if the accident occurred on the job. You may also sue their insurers. In limited cases, you may sue an auto manufacturer or retailer if a defect in the car itself caused the accident. Once you retain us, we will immediately begin investigating any and all defendants who may be liable to you.

Can I Recover for Property Damages and my Injuries?

Yes. In an auto accident claim, you will be able to recover for all of your injuries and financial costs related to the accident. This includes:

  • Damage to your car or other vehicle, including the cost of replacement
  • Cost of rental vehicles
  • Medical expenses
  • Lost wages, past and future
  • Pain and suffering

What if the Other Driver(s) Try to Put the Blame on Me?

Defendants and their insurers may try to blame you for causing the accident, but we will fully investigate the matter to present evidence of the defendant’s liability. Furthermore, even if you were partially at fault in causing the accident, you may still recover for your damages (reduced by your percentage of blame) so long as you were not more responsible than all of the defendants combined.

The Other Driver and/or His Insurer Offered me a Settlement – Should I Take it?

You never want to accept a settlement, sign a waiver, or commit to any agreement with a defendant or third-party insurer without speaking to a lawyer. Their interest is in convincing you to settle your claim for the least amount possible, while our interest is in making sure that your rights are fully represented under the law and that you get full compensation for all of your losses.

My Brother-in-Law Offered to Represent Me – Shouldn’t I Go with Someone I Know?

While your brother-in-law may be a fine lawyer, you want to make sure that you are going with an attorney who is experienced in bringing Iowa auto accident claims and who has the resources and know-how to get you your maximum recovery under the law. We work extensively with medical professionals and expert witnesses to prove causation on the part of the defendants and to present a compelling case for why you should recover your full range of damages, including future medical costs, lost wages, and reduced earning capacity. While many attorneys can persuade a defendant to offer a small settlement, your interest should be in finding an attorney who has the ability and commitment to fight for every penny you are owed.

What If I Can’t Afford an Auto Accident Attorney?

We represent auto accident claims on a contingency basis, meaning you will not be charged upfront, and we will only charge a legal fee if you recover.
